2025 Session Last amended: 2000 session

§ 169A.33 — Underage Drinking and Driving

Plain-Language Summary

It is a misdemeanor for anyone under 21 to drive with any evidence of alcohol consumption in their body. The penalty is a 30-day license suspension (or 180 days for a second offense). If the person is actually impaired, the regular DWI laws apply instead.

Practical Notes
Minnesota has a zero-tolerance policy for underage drinking and driving. Even if you are not over the 0.08 limit, any evidence of alcohol consumption (like the smell of alcohol) while driving is a crime if you are under 21.
