§ 169A.35 — Open Bottle Law

Plain-Language Summary

It is a misdemeanor to drink alcohol in a motor vehicle on a public road, or to have an open container of alcohol in the passenger area of a vehicle. The vehicle owner (or driver if the owner is not present) is also liable. Passengers in buses, pedal-pubs, and limos are exempt.

Practical Notes
Keep open alcohol in the trunk, not the passenger area. The glove compartment counts as the passenger area. Passengers on charter buses, party bikes, and limousines are allowed to drink.
