§ 169A.52 — Test Refusal or Failure; License Revocation

Plain-Language Summary

If you refuse a chemical test or fail one (blood alcohol of 0.08 or higher), the officer will report it to the state and your driver's license will be revoked. The officer will take your license on the spot and give you a temporary 14-day license.

Practical Notes
When this applies: After a DUI arrest in Minnesota when a driver refuses or fails a chemical test. Who this affects: Any driver who refuses or fails a breath, blood, or urine test. Key points: License revocation happens automatically through the Department of Public Safety, separate from any criminal charges. You will receive a temporary 14-day license. The revocation also applies to your right to operate off-road vehicles and motorboats. You have the right to request administrative and judicial review of the revocation. Even if you refuse a test, the officer may still obtain one if there is probable cause for criminal vehicular homicide.
