§ 16B.31 — Commissioner Must Approve Plans

The commissioner must approve all plans for state building construction, except highways, bridges, and buildings controlled by the University of Minnesota or Minnesota State Colleges and Universities. The commissioner can use design-build or construction manager at risk methods. Agencies must seek the maximum federal funding for each project. Spending more than the appropriation is a gross misdemeanor. The commissioner must also maintain an inventory of all state buildings.

Practical Notes
State building projects must go through the commissioner for plan approval, bidding, and construction supervision. Overspending on a building project beyond the appropriation is a criminal offense. The Capitol Area Architectural and Planning Board must approve plans for any project in the Capitol Area. The state can acquire land for buildings through purchase, gift, or condemnation.
