§ 16B.37 — Reorganization of Agencies

This law lets the commissioner of administration move staff, powers, or duties from one state agency to another to improve efficiency. The governor must approve any transfer first. Major transfers that move all or nearly all of an agency's work must be approved by the legislature before they take effect.

Practical Notes
Reorganization orders must be filed with the secretary of state and shared with legislative committee chairs. The commissioner of management and budget adjusts the budget to move the right amount of money to the agency receiving the transferred work. The commissioner can also direct one agency to do work for another agency and require payment for that work.
