§ 176.043 — Trucking and Messenger/courier Industries; Independent Contractors

Plain-Language Summary

In the trucking and messenger/courier industries, a vehicle operator is considered an employee (covered by workers' comp) unless all seven listed factors are met, in which case the operator is an independent contractor.

Practical Notes
If you drive a truck, van, or car for a trucking or courier company, you are probably covered by workers’ compensation unless you own or lease your vehicle, pay your own expenses, control how you do the work, are paid by the job (not by the hour), and have a written independent contractor agreement.
