§ 176.111 — Dependents, Allowances

Plain-Language Summary

When a worker dies from a work-related injury, this section provides benefits to the worker's dependents. A surviving spouse with no children gets 50% of the worker's weekly wage for 10 years. A surviving spouse with children gets 60-66% until the children are no longer dependents, then a reduced amount for 10 more years. The employer must also pay up to $15,000 for burial costs.

Practical Notes
When this applies: When a Minnesota worker dies from a work-related injury or disease. Who this affects: Surviving spouses, children, parents, and other dependents of deceased workers. Key points: Spouses and children under 18 are automatically considered dependents. Children remain dependents until age 25 if they are full-time students. The minimum death benefit is $60,000. If there are no dependents, $60,000 is paid to the worker’s estate. A surviving spouse who remarries still continues to receive benefits. Workers’ compensation death benefits are reduced by government survivor benefits so the combined total does not exceed 100% of the worker’s weekly wage.
