§ 176.151 — Time Limitations

Plain-Language Summary

An injured worker must file a workers' compensation claim within three years of the injury (or within three years of the last payment of benefits). Claims for occupational disease must be filed within three years of when the employee knew or should have known the disease was caused by work.

Practical Notes
If you are hurt at work, you generally have three years to file a workers’ compensation claim. For diseases caused by your job, the three-year deadline starts when you find out your disease is work-related. Do not wait – if you miss this deadline, you may lose your right to benefits.
