§ 176.194 — Prohibited Practices

Employers and insurers are prohibited from retaliating against an employee for filing a workers' compensation claim. It is also illegal to refuse to hire, fire, or discriminate against someone because they filed or might file a claim.

Practical Notes
Your employer cannot fire you, demote you, or treat you badly because you filed a workers’ compensation claim. If they do, you can file a separate lawsuit for retaliation and may be entitled to additional damages.
