§ 176.239 — Administrative Decision Concerning Discontinuance of Compensation

Plain-Language Summary

If an employer or insurer wants to stop paying workers' compensation benefits, the injured worker can request a quick administrative conference. The conference must be scheduled within 10 days. In most cases, benefits must continue being paid through the conference date.

Practical Notes
When this applies: When an employer or insurer discontinues (stops) temporary total, temporary partial, or permanent total disability payments. Who this affects: Injured workers whose workers’ compensation benefits have been cut off. Key points: If you disagree with the discontinuance, you must act quickly – generally within 12 calendar days of receiving the notice (30 days if you returned to work). You can make your request by phone or in person, not just in writing. Benefits generally continue through the conference date. Either side can request one continuance for good cause. After the conference, the compensation judge issues a written decision, which can be appealed to a full hearing.
