§ 176.871 — Report of Illness of Employee, Hearing on Claim

Plain-Language Summary

This section covers public employees at state, county, or city sanitariums, medical laboratories, or institutions employing licensed nurses who contract tuberculosis on the job. When the institution's superintendent or department head learns an employee whose duties involve patient contact or contaminated material has contracted tuberculosis at work, they must report the illness to the Workers' Compensation Division. The commissioner of labor and industry then sends the employee claim forms and sets the claim for hearing in the same manner as other public employees' workers' compensation claims.

Practical Notes
If you are a public employee at a state, county, or city sanitarium, medical laboratory, or other institution employing licensed nurses, and you contract tuberculosis through patient contact or contaminated material at work, your supervisor must report it to the Workers’ Compensation Division. You will then receive forms to claim medical, sanitarium, and compensation benefits, and your claim is heard and decided like other public employees’ workers’ comp claims.
