2025 Session Last amended: 1986 session

§ 177.44 — Highway Contracts; Hours of Labor; Wage Rates; Penalty

Plain-Language Summary

Workers on state highway construction contracts must be paid at least the prevailing wage for their trade in the area. They must also receive overtime pay of at least 1.5 times their hourly rate for hours beyond the prevailing hours. Violating these rules is a misdemeanor, and coercing workers to give up part of their wages can result in up to a year in prison.

Practical Notes
If you work on a state highway construction project, the prevailing wage rates and hours must be posted at the job site. It is illegal for a contractor to pressure you to give back any of your pay. Even employees who knowingly accept less than prevailing wage can face penalties. The Department of Transportation enforces this section.
