§ 179.06 — Collective Bargaining Agreements

This section sets the rules for how employers and employees start collective bargaining. Either side must give written notice of demands. If they cannot agree within ten days, either side can ask the commissioner of mediation services to step in. A strike or lockout cannot begin until ten days after filing a petition with the commissioner.

Practical Notes
There is a mandatory ten-day cooling off period before a strike or lockout can start. If a strike or lockout is not started within 90 days of filing the petition, a new petition must be filed. Note that the federal preemption ruling in Faribault Daily News limits the ten-day waiting period for employers and unions covered by federal labor law.
