§ 179.16 — Collective Bargaining Representatives

A union chosen by a majority of employees in a bargaining unit becomes the exclusive representative for all employees in that unit. The commissioner of mediation services can investigate disputes about who represents workers and certify the proper representative. The commissioner decides whether the appropriate bargaining unit is by employer, craft, or plant.

Practical Notes
Even with an exclusive union representative, individual employees can still bring their own grievances to the employer. The commissioner can use secret ballot elections to determine representation. An employer-dominated union cannot be certified. Once certified, the commissioner generally will not reconsider representation for at least one year.
