§ 185.02 — Restraining Order or Injunction, When Not Issued

Plain-Language Summary

Courts in Minnesota generally cannot issue restraining orders or injunctions in disputes between employers and employees unless specific conditions are met. The court must hold a hearing and find that an injunction is necessary to prevent irreparable harm to property. A temporary restraining order without a hearing is only allowed if violence is actually happening or about to happen.

Practical Notes
This limits when employers can get courts to stop labor activities. The employer must show specific property damage, not just inconvenience or lost profits. Both sides must be treated equally in any restraining order.
