§ 192A.57 — Malingering

Plain-Language Summary

Punishes malingering, which means faking illness or injury to avoid military duties.

Any person subject to this code who for the purpose of avoiding work, duty, or service in the state military forces not in federal active service:

(1) feigns illness, physical disablement, mental lapse, or derangement; or

(2) intentionally inflicts self injury;

shall be punished as a court-martial may direct.

Practical Notes

Pretending to be sick or deliberately injuring yourself to get out of work or duty is a military offense.
