2025 Session Last amended: 2025 session

§ 204C.06 — Conduct in and Near Polling Places

Plain-Language Summary

People must be able to get to and from the polling place without interference. No one except voters, election officials, and authorized observers may stand within 100 feet of the building. Inside the polling place, strict rules govern who may be present and how close anyone may get to voting booths. Damaging election materials is a gross misdemeanor or felony. Intoxicated individuals are not allowed to vote.

Practical Notes
Voters are protected from intimidation and interference at the polls. News media may observe but must stay six feet from voters and not talk to them. Peace officers may not enter unless called by an election judge. Election judges can appoint a sergeant-at-arms to keep order.
