§ 204C.22 — Determining Voter's Intent

Ballots should not be thrown out for minor errors if the voter's intent can be determined from the face of the ballot. A ballot that votes for too many candidates is only defective for that one office. Write-in names count even without filling in the oval. Misspellings are ignored if the intended candidate is clear. A ballot marked to identify the voter is entirely defective.

Practical Notes
Minnesota courts look at voter intent when deciding whether to count a ballot. Minor errors like slight smudges, misplaced marks, or misspelled write-in names usually will not disqualify your vote. However, deliberately marking your ballot to identify yourself makes the entire ballot invalid.
