§ 223.23 — Annual Examination Required; Supplemental Examinations

Plain-Language Summary

This section requires that every licensed grain buyer in Minnesota undergo an annual inspection by the Commissioner of Agriculture or by the USDA Agricultural Marketing Service. The inspection must include measuring all grain the buyer owns or holds. Additional inspections can be required anytime the Commissioner determines they are needed.

Practical Notes
Annual inspections help protect farmers by verifying that grain buyers are maintaining adequate grain supplies and financial reserves. If the Commissioner discovers problems during an inspection, they can take regulatory action including suspending or revoking the buyer’s license. Farmers who have concerns about a licensed grain buyer should report them to the Commissioner, who can order a supplemental examination.
