§ 228.49 — Negotiating Bill for Goods Carrier Does Not Have

Plain-Language Summary

It is a crime to knowingly negotiate or transfer a bill of lading for value when you know the carrier does not actually have or control some or all of the goods described in the bill. This is a felony-level offense.

Practical Notes
A conviction can result in up to 5 years in prison and a fine of up to $10,000 per offense. This law targets fraud in the transfer of shipping documents for goods that are not actually in the carrier’s possession.
