§ 241.26 — Private Employment of Inmates of State Correctional Institutions in Community

The commissioner of corrections can release eligible inmates to work at paid jobs, look for work, or attend school or job training in the community. Inmates in the work release program must return to their facility when not working or in school. Their earnings are used first to pay for room and board, then travel costs, family support, restitution, and fines.

Practical Notes
Failing to return from work release is treated as an escape under Minnesota law. Inmate wages in this program cannot be garnished or seized by creditors. The commissioner can also place participants under house arrest with electronic monitoring instead of in a detention facility. After 30 days in a work release center, inmates may be eligible for furloughs.
