2025 Session Last amended: 2024 session

§ 241.69 — Mental Health Unit; Establishment

Plain-Language Summary

The commissioner of corrections must set up a mental health unit at one of the adult correctional facilities to treat inmates who become mentally ill. If an inmate is believed to be mentally ill, they must be examined by a qualified physician or mental health professional. Inmates needing short-term care can be transferred to the mental health unit, while those needing long-term care may be committed by a court.

Practical Notes
If an inmate’s prison sentence ends before their mental health treatment is complete, they can be transferred to a state hospital for continued treatment. The state pays for commitment proceedings. When an inmate is discharged from the mental health unit, the certification of recovery is sent to the commissioner, who must consider it when planning the inmate’s supervision upon release.
