§ 244.12 — Intensive Community Supervision

Plain-Language Summary

The Commissioner of Corrections can place eligible offenders on intensive community supervision instead of keeping them in prison. This program is for offenders whose probation was revoked, or who have sentences of 30 months or less and have already served some time. Offenders convicted of murder, manslaughter, sex crimes, or vehicular homicide are not eligible.

Practical Notes
The offender must agree to participate, and the sentencing court must be notified. Offenders serving mandatory minimum sentences are also excluded. The program details are described in sections 244.14 and 244.15. Anyone whose presence in the community would endanger public safety cannot participate.
