§ 244.19 — Probation Services and Officers

Plain-Language Summary

This law sets up how counties and Tribal Nations provide probation services for adult misdemeanors and juvenile cases. Counties can hire their own probation officers (CPO jurisdictions) or ask the state to provide them (non-CPO jurisdictions). Tribal Nations can also provide probation services to enrolled members and their household members. Probation officers have peace officer powers and must follow court orders.

Practical Notes
If a county switches from providing its own probation services to receiving state services (or vice versa), displaced employees must be hired by the new employer at no loss of salary or benefits. CPO jurisdictions must develop comprehensive plans with the commissioner to receive funding. Tribal Nation sovereignty is expressly preserved in all probation service arrangements.
