§ 245I.13 — Critical Incidents

Behavioral health providers must have procedures for identifying, responding to, and reporting critical incidents such as client injuries, deaths, medication errors, and other serious events.
245I.13 CRITICAL INCIDENTS.
If a license holder is licensed as a residential program, the license holder must report all critical incidents to the commissioner within ten days of learning of the incident on a form approved by the commissioner. The license holder must keep a record of critical incidents in a central location that is readily accessible to the commissioner for review upon the commissioner’s request for a minimum of two licensing periods.

Practical Notes
Providers must report serious incidents to the state. If a critical incident occurs during your care, the provider should notify you and your family and document what happened and what corrective steps were taken.
