§ 253B.092 — Administration of Neuroleptic Medication

This section sets the rules for when a treatment facility can give a committed patient neuroleptic (antipsychotic) medication against the patient's wishes. The court must hold a separate hearing, and the patient has the right to refuse and to present evidence at that hearing.

A committed patient cannot be forced to take antipsychotic medication unless a court specifically orders it after a hearing. The patient has the right to object and present evidence. In an emergency, medication may be given for up to 14 days while waiting for the hearing.
