§ 253D.24 — Return of Absent Person

Plain-Language Summary

This section sets out what happens when a committed person leaves the Minnesota Sex Offender Program without permission. The facility must report the absence to law enforcement, who must enter the person into the National Crime Information Center database. Law enforcement officers anywhere in Minnesota can then apprehend and hold the person. Privacy laws do not prevent sharing information about an absent committed person to help law enforcement find them.

Practical Notes
Being absent without authorization from the Minnesota Sex Offender Program can result in criminal charges under section 609.485 (escape from civil commitment), in addition to being returned to the facility. Leaving without permission even during a provisional discharge can trigger revocation of that discharge and return to secure confinement. The program can hold the person in jail for up to 24 hours pending transfer back to a secure facility.
