§ 253D.29 — Transfer

Plain-Language Summary

This section governs when and how a committed person can be transferred from a secure treatment facility to a less restrictive setting. The decision must consider clinical progress, security needs, continued need for institutionalization, and public safety. A transfer can be revoked if the person's behavior creates safety risks or if their clinical condition worsens, and the person can challenge a revocation by petitioning the special review board.

Practical Notes
Transfer to a less secure setting is an intermediate step between full secure confinement and provisional discharge. Committed persons who are making treatment progress should work with their treatment team toward a formal transfer petition. If a transfer is revoked, the person has seven days to petition the special review board for review of the revocation decision.
