§ 253D.30 — Provisional Discharge

Plain-Language Summary

This section sets the standards for provisional discharge from the sex offender commitment program. A person can only be provisionally discharged if they can adjust to open society and their discharge plan provides adequate public safety protections. Provisional discharge is not the same as full discharge — the person remains under commitment and subject to conditions. The discharge can be revoked if the person violates conditions or shows dangerous behavior.

Practical Notes
Provisional discharge is a significant step but does not end the commitment. People on provisional discharge must follow their plan and continue treatment as required. Any violation of plan conditions or dangerous behavior can lead to immediate return to the secure facility without advance notice. A person challenging a revocation must petition the special review board within seven days of receiving the revocation report.
