§ 256.046 — Administrative Fraud Disqualification Hearings

Plain-Language Summary

Requires local agencies to hold an administrative hearing when someone is accused of wrongfully getting public assistance benefits, such as general assistance, Minnesota supplemental aid, or medical assistance, when the case is not being handled as a crime.

Practical Notes
If you are accused of benefits fraud but no criminal charges are filed, the county must hold an administrative hearing instead. You have the right to a hearing before being disqualified from benefits. If criminal charges are also filed, you can ask to delay the administrative hearing.
