§ 256B.058 — Treatment of Income of Institutionalized Spouse

Plain-Language Summary

Protects the income of the spouse living at home when the other spouse is in a nursing home on Medical Assistance. The at-home spouse gets a monthly income allowance based on federal poverty guidelines and shelter costs, and a family allowance may be set aside for dependent family members.

Practical Notes
If your spouse enters a nursing home and qualifies for Medical Assistance, you are allowed to keep a certain amount of monthly income for your living expenses. The state cannot take all of your household income to pay for nursing home care. If the standard allowance is not enough due to exceptional financial hardship, you can request a higher amount.
