§ 256G.04 — Determination of Residence

Plain-Language Summary

This section explains when and how residence is determined. Residence is set as of the date the local agency receives your application or your eligibility date, whichever is later. If you leave Minnesota temporarily, you keep your Minnesota residence. If you enter a facility in another state, Minnesota may still be financially responsible if the placement was arranged by a Minnesota agency under a written treatment plan.

Practical Notes
If you apply for services in one county and then move to another county before your application is approved, your residence is still determined based on where you lived when you applied. If you leave Minnesota temporarily, your county and state residence continue. Out-of-state placements arranged by a Minnesota agency may remain Minnesota’s financial responsibility.
