§ 256G.09 — Determining Financial Responsibility

Plain-Language Summary

This section sets up the process for resolving disputes between counties about which one is financially responsible. If a county believes another county should be responsible, it must transfer the case within 60 days. The receiving county has 30 days to accept or reject responsibility -- failure to respond means it accepts. If counties disagree, the commissioner of human services decides, and counties can appeal to district court.

Practical Notes
County financial responsibility disputes follow a strict timeline. The transferring county has 60 days to send the case, and the receiving county has 30 days to respond. If counties cannot agree, the commissioner makes a binding decision within 60 days. Services must continue during any dispute or appeal, so the person receiving services should not experience interruption.
