§ 256R.11 — Nonallowed Costs

Certain costs cannot be included when setting nursing facility payment rates. These include political contributions, lobbying expenses, promotional advertising, fines for health violations, club memberships, and costs related to influencing employees about unionization.

Practical Notes
Nursing facilities cannot pass these costs on through their Medicaid rates. Legal costs for unsuccessful challenges to government decisions are also excluded. The commissioner can exclude additional costs by rule if they are not directly related to resident care. Anti-union campaign costs are specifically prohibited from rate calculations.
