§ 257.62 — Blood and Genetic Tests

Governs court-ordered blood and genetic (DNA) testing in paternity cases. If test results show a 99% or greater probability of paternity, a legal presumption of fatherhood is created that can only be overcome by clear and convincing evidence.

Practical Notes
Genetic testing is the single most powerful piece of evidence in a paternity case. Test results at or above 92% probability trigger temporary child support obligations, and results at or above 99% create a presumption of paternity. Objections to test results must be filed in writing within 30 days of service. A sperm or egg donor for assisted reproduction cannot use this section to claim parental rights.
