§ 257B.04 — Contents of Designation

Plain-Language Summary

A standby or temporary custodian designation must be in writing and identify the parent making the designation, the children, the other parent if any, the custodian, and the specific triggering events that will activate the designation. The document must be signed by the parent in front of two adult witnesses who also sign, and include the custodian's signed consent. The law provides an optional form that parents can use to complete the designation.

Parents should use the optional form provided in this section or consult an attorney to draft a proper designation. The designation must clearly state the triggering events so there is no ambiguity about when the custodian’s authority begins. Different triggering events (incapacity vs. death) can activate different standby custodians.
