§ 259.55 — Payment of Birth Parent Expenses; Penalty

Plain-Language Summary

Limits what expenses adoptive parents may pay on behalf of birth parents to counseling, medical, legal, transportation, and reasonable living expenses during pregnancy. Paying for anything else in connection with an adoption placement is a gross misdemeanor.

Practical Notes
Adoptive parents can pay for a birth parent’s medical, legal, and counseling costs, plus reasonable transportation and living expenses during pregnancy. Paying for anything beyond these categories, such as gifts, education, or lost wages, is illegal. Birth parents can never be required to reimburse adoptive parents, even if they withdraw consent.
