§ 259.58 — Communication or Contact Agreements

Plain-Language Summary

Allows adoptive parents and birth relatives or foster parents to enter legally enforceable agreements for ongoing communication or contact after an adoption, provided the agreement is approved by the court and found to be in the child's best interests.

Practical Notes
Open adoption agreements can be made legally enforceable in Minnesota if put in writing and approved by the court before the adoption decree is entered. Failure to comply with a contact agreement is not grounds for overturning the adoption. If disputes arise, the parties must attempt mediation before going back to court.
