§ 260C.175 — Taking Child Into Custody

Plain-Language Summary

A child can only be taken into custody with a court order, by a police officer who believes the child is in danger, or by a police officer or probation officer who believes the child has violated probation. When a child is taken into custody, the officer must tell the parent about the right to place the child with a relative instead of in a shelter.

Practical Notes
If your child has been taken into custody, you have the right to request that the child be placed with a relative rather than in a foster care facility.
