§ 260D.10 — Termination of Voluntary Placement Agreement

Either the parent or the agency can end a voluntary foster care for treatment agreement by giving written notice. After notice is given, the child's return home must happen no sooner than 72 hours and no later than 30 days later, unless both sides agree to a different schedule. The parent can appeal if the agency ends the agreement, and the agency must provide notice of that right to a fair hearing.

Practical Notes
Parents who want their child home can terminate the voluntary agreement with a written notice — they do not need court approval to do so. However, if the agency terminates the agreement and you disagree, you can request a fair hearing to challenge the decision. Transition planning is required before the child returns home, including increased visits and a plan for what services will be in place.
