2025 Session Last amended: 2009 session

§ 261.035 — Cremation, Burial, and Funerals at Expense of County

Plain-Language Summary

When a person dies without money for a funeral, the county must first check for prepaid funeral plans. If there are none, the county pays for cremation and burial. However, if cremation goes against the dead person's beliefs, faith tradition, or the wishes of their spouse or next of kin, the county must provide a traditional burial and funeral instead.

Practical Notes
If a family member dies without funds for final arrangements, contact the county board. The county must respect the deceased person’s religious or personal preferences regarding cremation versus burial. If no one knows the person’s wishes and no next of kin can be found, the county may choose cremation as the default.
