§ 270A.04 — Agency Participation

Plain-Language Summary

This section explains when a government agency can and cannot use the Revenue Recapture Act to collect a debt. The agency cannot use this process if the debtor has a written payment plan that bars recapture, if collecting would cause a loss of federal funds, if the agency lacks the debtor's identifying information, or if the debt is too old under the statute of limitations.

Practical Notes
If you have a written payment agreement with a government agency that says they will not use revenue recapture, and you are keeping up with your payments, the agency cannot take your tax refund. Also, debts that are past the statute of limitations under section 541.05 cannot be collected this way. This collection method is in addition to other methods the agency may use.
