2025 Session Last amended: 2008 session

§ 270A.08 — Notice and Hearing Required

Plain-Language Summary

This section requires the government agency to send written notice to the debtor within five days of submitting the debt for collection. The notice must clearly explain what the debt is for, the dates it was incurred, and the agency's plan to take the debtor's refund. The debtor has the right to request a hearing to contest the claim within 45 days.

Practical Notes
You must receive written notice before your refund can be taken. The notice must be specific about why you owe the debt. If you believe the debt is wrong, you have 45 days from the date the notice was mailed to request a hearing in writing. If you never received the notice, the 45-day clock does not start until you actually get it, and you can request a hearing on the notice issue itself.
