§ 295.58 — Deposit of Revenues and Payment of Refunds

Plain-Language Summary

All money collected from the health care provider tax, including penalties and interest, goes into the health care access fund. The insurance premiums tax on HMOs and nonprofit health plans also goes into this fund. The commissioner of revenue is automatically given the money needed to pay refunds under this chapter.

Practical Notes
The health care access fund is the dedicated funding source for MinnesotaCare and related health care programs. This section ensures that revenue from the health care provider tax is earmarked for health care purposes rather than going into the general fund. Refunds are automatically appropriated, so eligible taxpayers do not need a separate legislative action to receive their refunds.
