2025 Session Last amended: 2011 session

§ 295.59 — Severability

Plain-Language Summary

If a court strikes down any part of the MinnesotaCare tax law as unconstitutional or in violation of federal law, the rest of the law stays in effect. The legislature declared that it would have passed the law even without the invalid parts.

Practical Notes
This is a standard severability clause that protects the rest of the MinnesotaCare tax law if any single provision is found invalid by a court. It means that a successful legal challenge to one part of the tax would not automatically eliminate the entire tax system.
