§ 301B.01 — Public Service Corporations; Purposes

Plain-Language Summary

This section authorizes corporations to be formed for the purpose of building and operating public infrastructure such as railways, telephone and telegraph lines, canals, dams, and systems for supplying water, light, heat, or power to the public. These are called public service corporations. Any company that wants to build railways, pipelines, or pedestrian tunnels on city streets must first get a franchise from the city and pay the city for that right.

Practical Notes
Public service corporations are utilities and infrastructure companies — think electric companies, water utilities, and pipeline operators. The franchise requirement means cities have the power to negotiate the terms under which these companies use public streets and rights-of-way. This is the legal basis for franchise agreements between cities and cable companies, natural gas utilities, and similar providers that use public land for their infrastructure.
