§ 307.01 — Plat and Record

Plain-Language Summary

Private individuals and religious corporations can establish a cemetery on their own land by surveying it, creating a plat, marking a corner with a monument, and filing the plat with the county recorder. Cemetery lots can be subdivided later without a new county filing if markers are placed.

Practical Notes
If you want to establish a private cemetery, you must hire a surveyor, create a plat, and file it with the county recorder. Each lot in any future subdivision must have a cement or permanent marker at its corner.
