§ 334.06 — Agreements to Share Profits; Banks for Farm Cooperatives

The usury laws do not apply to business investment agreements where one person provides money for a venture and the other agrees to repay it with legal interest plus a share of the profits. The usury laws also do not apply to banks for farm cooperatives under the Federal Farm Credit Act.

Practical Notes
This protects common business arrangements like profit-sharing loans. If someone invests money in your business and you agree to share profits on top of repaying the loan with interest, that is not considered usury. Federal farm credit institutions are also free from state interest rate limits.
