§ 356.48 — Revocation of Optional Annuity Due to Marriage Dissolution or Annulment

Plain-Language Summary

This section allows a retired pension member to cancel a joint and survivor annuity form that named a former spouse as the survivor beneficiary, if the marriage has ended by divorce or annulment. The member's annuity is then recalculated as a single-life annuity, unless a court order requires otherwise.

Practical Notes
If you are divorced and your ex-spouse was named as the survivor beneficiary on your pension, you can generally revoke that designation and increase your monthly payment to a single-life amount. However, this does not apply if a divorce decree or court order requires the survivor benefits to continue.
