§ 363A.23 — Exemption Based on Education

This section creates exemptions to discrimination rules for certain education situations. Religious schools may prefer applicants of the same religion. Private single-sex schools may limit enrollment by sex. Schools may have separate athletic teams for boys and girls if they meet legal requirements.

Practical Notes
If you attend or work at a religious school, the school may give preference to applicants of the same faith. Schools can still use academic qualifications for admissions. Separate boys and girls athletic teams are allowed if they meet the standards in section 121A.04. Federal disability rights laws still apply alongside Minnesota law.
